Amateur Swimming Association Registered Swim Schools Summary of Civil Liability Protection

Introduction

It is of vital importance that all Swim Schools protect themselves against the disastrous consequences of liability for injury or damage arising out of their actions and this includes the actions of all directors, partners, employees and voluntary helpers. It is essential that adequate liability insurance is arranged to avoid such consequences.

Standard insurance protection is such that the exclusions vary considerably from Policy to Policy. This is an entirely unsatisfactory situation because all those involved need to be confident, providing they act reasonably and stay within the law, that they have the appropriate insurance to protect them.

With the above in mind, Perkins Slade Limited, in conjunction with the Amateur Swimming Association and Royal & Sun Alliance Insurance plc have arranged Liability cover that is designed to provide the necessary protection for Swim Schools who are member schools of  the Institute of Swimming and registered with the Amateur Swimming Association.

It is important to note this policy wording and preferential rates only applies to swim schools who hire the use of pools from third parties. 

If a swim school owns its own pool or has accepted, under contract, the responsibility of running a swimming pool it will require more specific insurance and should discuss these requirements with Perkins Slade Limited.

Civil Liability

This insurance will protect your business against the disastrous consequences of liability for loss, injury or damage, and this includes the actions of all involved in the business. Responsibility for Court costs and Damages awarded, where an action has been brought against a Business, involves all individuals and activities and it is essential that adequate Liability insurance is arranged to cover any eventuality.

Public Liability

Bodily injury to third parties and/or damage to third party property arising out of the insured activities. Cover includes, damage to leased or rented premises, trespass, nuisance & pollution. The interest of principals (land/property owners’ etc.) is also included.

Professional Indemnity

Loss (financial or otherwise) that arises out of Errors and Omissions (e.g. bad advice or failure to act).

Products Liability

Bodily injury to third parties and/or damage to third party property arising out of any goods sold or supplied by the Insured.

Directors & Officers Liability

Indemnity to the Directors of Officers of the insured for wrongful acts.

Abuse

Damages and associated legal costs following civil claims for injury caused acts of abuse.  (This cover may be subject to an additional questionnaire).  It is important to note that the School is protected but there is no cover for the individual accused/alleged to be the abuser.

Limit of Indemnity

The Limit of Indemnity under the combined Policies is: a total of either £2,000,000 or £5,000,000 at your option

Please note that the Civil Liability protection is subject to terms conditions and exclusions and you should refer to your individual policy document for those in place for your swim school.

Employers Liability – Optional Additional Protection

You are required by law to have Employers’ Liability Insurance for people who you employ.  However, people who you normally think of as self-employed may be considered as your employees for the purposes of Employers’ Liability Insurance.  Whether you choose to call it your contract of employment or a contract for services is largely irrelevant.  What matters is the real nature of your relationship with the people who work for you and the degree of control you have over the work they do.

In general, you may need Employers’ Liability Insurance for someone who works for you if any of the following apply:

  • you have the right to control where and when they work and how they do it
  • you supply most materials and equipment
  • you have the right to any profit your workers make although you may choose to share this with them through commission, performance pay or shares in the company. Similarly, you will be responsible for any losses 
  • you deduct National Insurance and Income Tax from the money you pay them
  • you require that person only to deliver the service and they cannot employ a substitute if they are unable to do the work
  • they are treated in the same way as other employees, for example if they do the same work under the same conditions as someone you employ
